RE: The tariff classification of a nonwoven material, for use in the manufacture of roller covers in the steel sheet blank washing machines employed in both the automotive and steel industries, from Germany.

Dear Mr. Jager:

In your letter which was received October 4, 2010, you requested a tariff classification ruling.

You submitted four representative samples differing mainly in color and thickness. They are identified as follows: Viledon C 1905, C 1906, C1900/633 and 1907, respectively.

Your literature indicates that these materials are essentially constructed as follows:

Unspecified textile fibers that may be synthetic or natural are mechanically bonded via a needling process in order to create a matrix necessary for high mechanical stability. This, according to your literature, imbues the material with high tensile strength, tear strength and abrasion resistance. Next, this mechanically pre-bonded web is treated with a chemical binder (e.g. rubber) and/or receives a thermal bonding treatment. This adds elasticity and further improves the mechanical stability of the material. Finally, you indicate that a special finishing step may also be added later in order to achieve other desirable surface properties. This material, according to your correspondence, will be imported as roll goods having 1.85-meter widths and 100-meter lengths. All of the samples were informally weighed and were found to weigh well over 150 grams per square meter.

Classification of this material will be as follows:

If the material is of filaments, the applicable subheading for the product will be 5603.14.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, of man-made filaments, weighing more than 150g/m², ... not laminated. The rate of duty will be Free.

If the material is of staple fibers, the applicable subheading for the product will be 5603.94.9090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for nonwovens, whether or not impregnated, coated, covered or laminated, weighing more than 150g/m², not laminated, other, … of staple fibers. The duty rate will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
